FoodByUs x Square – Exclusive $5,500 Offer
1. The Promoter
The Promoter is FoodByUs Pty Ltd (ABN 27 610 884 083), of 7/418a Elizabeth Street, Surry Hills NSW 2010, telephone 1300 725 899, email support@foodbyus.com (“FoodByUs” or “Promoter”).
2. The Offer
2.1 Eligible Square customers who sign up to FoodByUs through the Square partner campaign will receive:
(a) six (6) FoodByUs vouchers valued at AUD $500 each, with a total voucher value of AUD $3,000; and
(b) complimentary FoodByUs account setup and configuration, valued at AUD $2,500.
2.2 The total stated value of the Offer is AUD $5,500.
2.3 The Offer is available exclusively to eligible customers referred to FoodByUs through Square and is not available through FoodByUs’ standard sign-up channels.
2.4 The Offer is subject to these Terms and Conditions.
3. Promotional Period
3.1 The Offer commences at [12:00 am AEST on DATE] and closes at [11:59 pm AEST/AEDT on DATE] (“Promotional Period”), unless extended, varied or withdrawn by FoodByUs in accordance with these Terms and Conditions.
3.2 Eligible customers must submit the designated Square x FoodByUs lead form during the Promotional Period.
4. Eligibility
4.1 The Offer is open to businesses that:
(a) are existing Square customers and have been invited or referred to participate in the FoodByUs offer through Square;
(b) operate an eligible hospitality business in an area currently serviced by FoodByUs;
(c) submit the designated Square x FoodByUs lead form during the Promotional Period;
(d) successfully complete FoodByUs’ qualification and onboarding process;
(e) create and maintain an active FoodByUs buyer account;
(f) connects their Square service to their FoodByUs account (note: this is free of charge), and maintains the connection for the duration of the offer
(g) meet any applicable ordering and account requirements set out in these Terms and Conditions.
4.2 Unless otherwise agreed by FoodByUs in writing, the Offer is only available to new FoodByUs customers (or returning customers who have not ordered via FoodByUs for 12 months or more). It is not available to businesses with an existing FoodByUs buyer account who have placed an order within the last 12 months, or who have done so via FoodByUs at any venue under the same owners as the referred business seeking the Offer.
4.3 Only one Offer may be claimed per business or associated business group, regardless of the number of venues, locations, Square accounts or FoodByUs accounts operated by that business.
4.4 FoodByUs reserves the right to verify a customer’s eligibility, including their Square referral status and business details, before approving the Offer.
4.5 Submission of the lead form does not automatically guarantee eligibility for or acceptance into the Offer.
5. FoodByUs Vouchers
5.1 Eligible customers will receive a maximum of six (6) AUD $500 FoodByUs vouchers, representing a maximum total voucher value of AUD $3,000.
5.2 Vouchers will be issued once per month for the customer’s first six months, subject to the customer continuing to satisfy the eligibility of the Offer.
5.3 Each $500 voucher:
(a) can only be used towards eligible purchases made through the FoodByUs platform;
(b) must be redeemed within 30 days of issue;
(c) is limited to one voucher per eligible redemption period unless otherwise approved by FoodByUs;
(d) cannot be exchanged, transferred or redeemed for cash;
(e) cannot be applied retrospectively to orders already placed or invoiced;
(f) cannot result in a cash refund or cash balance where the value of the eligible order is less than the voucher value; and
(g) cannot be combined with another promotional voucher unless expressly permitted by FoodByUs.
5.4 The customer must maintain an active FoodByUs account in good standing to receive any outstanding vouchers.
5.5 Any unused or expired voucher value will be forfeited and will not be replaced or converted to cash.
5.6 If a customer’s FoodByUs account is closed, suspended or becomes ineligible before all six vouchers have been issued, any remaining unissued vouchers will be forfeited.
5.7 Suppliers will set their own minimum order requirements, delivery fees and serviceable areas by postcode on the FoodByUs platform. FoodByUs is not in control of the supplier’s settings, which may change from time to time based on the supplier’s business rules.
6. Complimentary Account Setup & Configuration
6.1 Eligible customers will also receive complimentary FoodByUs account setup and configuration, with a stated value of AUD $2,500.
6.2 Setup and configuration includes, but is not limited to, the following services as applicable to the customer’s needs:
(a) initial FoodByUs account configuration;
(b) assistance connecting or setting up suppliers;
(c) assistance configuring users, venues, pantry lists and ordering requirements;
(d) Up to two training sessions which may include the chef/kitchen operator, owner/manager and/or accounts/finance;
(e) Square POS integration and category mapping;
(f) Accounting software integration and category mapping (provided the customer uses Xero, MYOB or Quickbooks);
(g) Menu Costing configuration; and
(h) other reasonable implementation assistance determined by FoodByUs.
6.3 The exact scope of setup and configuration will depend on the customer’s requirements and will be determined by FoodByUs during the onboarding process.
6.4 The AUD $2,500 amount represents the stated value of the setup and configuration service. It is not a cash credit and cannot be exchanged, transferred, refunded or redeemed for cash.
7. Square
7.1 Square facilitates the referral of eligible customers to FoodByUs but the FoodByUs Offer, vouchers, onboarding and FoodByUs services are provided and administered by FoodByUs.
7.2 Use of Square products and services remains subject to Square’s applicable terms and conditions.
7.3 Use of the FoodByUs platform remains subject to FoodByUs’ standard terms and conditions.
8. Privacy
8.1 FoodByUs collects personal and business information provided through the Square x FoodByUs lead form for the purposes of:
(a) assessing eligibility for the Offer;
(b) contacting and qualifying prospective customers;
(c) establishing and administering FoodByUs accounts;
(d) providing the Offer and associated onboarding services; and
(e) measuring and administering the Square x FoodByUs partnership campaign.
8.2 FoodByUs may share information relating to participation in the campaign with Square where reasonably necessary to administer, measure or report on the partnership campaign, subject to applicable privacy laws.
8.3 FoodByUs will handle personal information in accordance with its Privacy Policy and the Privacy Act 1988 (Cth), including the Australian Privacy Principles.
9. General Conditions
9.1 FoodByUs reserves the right to verify the identity, business details and eligibility of any customer claiming the Offer.
9.2 FoodByUs may withhold or withdraw the Offer, including any unissued vouchers, where it reasonably believes that a customer:
(a) has provided false, misleading or incomplete information;
(b) has attempted to obtain multiple Offers for the same or associated business;
(c) has misused or attempted to misuse a voucher or promotional benefit;
(d) has engaged in fraudulent activity; or
(e) has otherwise breached these Terms and Conditions or FoodByUs’ standard platform terms.
9.3 FoodByUs reserves the right to vary, extend, suspend or withdraw the Offer where reasonably necessary, subject to applicable law. Any change will not affect vouchers already validly issued unless required by law or necessary to address fraud, misuse or circumstances beyond FoodByUs’ reasonable control.
9.4 The Offer is not transferable and cannot be exchanged or redeemed for cash.
9.5 To the maximum extent permitted by law, FoodByUs is not responsible for any loss arising from technical failures, incorrect information supplied by a participant, expired vouchers or circumstances outside FoodByUs’ reasonable control.
9.6 Nothing in these Terms and Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law.
9.7 These Terms and Conditions are governed by the laws of New South Wales, Australia, and the parties submit to the non-exclusive jurisdiction of the courts of New South Wales.
