1. The Promoter

The Promoter is FoodByUs Pty Ltd (ABN 27 610 884 083), of 7/418a Elizabeth Street, Surry Hills NSW 2010, telephone 1300 725 899, email support@foodbyus.com (“Promoter”).

 

2. Promotion Type

This is a game of chance. A trade promotion lottery conducted under the Community Gaming Act 2018 (NSW) and the Community Gaming Regulation 2020 (NSW), and in accordance with the relevant legislation of each participating Australian state and territory.

 

3. Promotional Period

The Promotion commences at 12:00 am AEST on 7 April 2026 and closes at 11:59 pm AEST on 30 June 2026 (“Promotional Period”). All times referred to in these Terms and Conditions are Australian Eastern Standard Time (AEST).

 

4. Eligibility

4.1 Entry is open to businesses and their authorised representatives who:

(a) are registered customers of the FoodByUs platform (https://app.foodbyus.com.au);

(b) are located in Australia;

(c) are aged 18 years or over at the time of entry; and

(d) are not residents of the Australian Capital Territory (ACT).

4.2 The following persons are not eligible to enter:

(a) directors, officers, employees, and contractors of the Promoter and their immediate family members;

(b) directors, officers, employees, and contractors of Unilever Australia Limited (ABN 56 076 662 706) and their immediate family members;

(c) any person involved in conducting the Promotion, including determining the winners; and

(d) any person involved in the management of any business benefiting from this Promotion.

(e) any ‘key accounts’ who already have commercial arrangements in place with Unilever, including distributor’s (as applicable) resellers, wholesalers, suppliers, contract customers, contract caterers or operators with exclusive supply agreements and Quick Service Restaurant chains as reasonably determined by the Promoter (e.g., McDonalds, Hungry Jacks, Dominos, Pizza Hut, KFC, Red Rooster, Oporto)

4.3 “Immediate family member” means a spouse, de facto partner, parent, natural or adopted child, or sibling (whether natural or adopted) of the relevant person, whether or not they live at the same address.

4.4 The Promoter reserves the right to verify the validity of entries and the identity and eligibility of entrants at any time. The Promoter’s decision on eligibility is final and no correspondence will be entered into.

 

5. How to Enter

5.1 To enter, eligible participants must, during the Promotional Period:

(a) opt in to the Promotion via the FoodByUs platform prompt;

(b) place an order through the FoodByUs platform that includes three (3) or more participating Unilever Food Solutions products (as listed in Schedule 1 or on the promotion page at https://www.foodbyus.com.au/unilever-promo/); and

(c) achieve a minimum spend of $150 (excluding GST) on participating Unilever Food Solutions products in that single invoice.

5.2 Each qualifying invoice that satisfies conditions 5.1(a)–(c) constitutes one (1) entry into the next scheduled draw.

5.3 Multiple entries are permitted. Each separate qualifying invoice earns an additional entry. There is no limit on the number of entries per entrant.

5.4 Rollover entries. An entry that does not win a draw will automatically roll forward and remain valid for all subsequent draws during the Promotional Period, accumulating until the entrant wins or the final draw is conducted.

5.5 Entry is free. The purchase of Unilever Food Solutions products at their normal value is a condition of entry but does not constitute an entry fee.

5.6 Entries are deemed to be received at the time the qualifying invoice is processed and confirmed by the FoodByUs platform, not at the time of order placement.

5.7 Incomplete, ineligible, or non-compliant entries will be deemed invalid.

 

6. Participating Products

6.1 The participating Unilever Food Solutions products are listed in Schedule 1 to these Terms and Conditions and are also available on the promotion page at https://www.foodbyus.com.au/unilever-promo/.

6.2 The Promoter reserves the right to substitute participating products at any time if a product becomes unavailable, provided such substitution does not materially affect the nature of the Promotion.

 

7. The Draws

7.1 A total of six (6) draws will be conducted during the Promotional Period. One (1) winner will be selected per draw.

7.2 Draws will be conducted on the following dates (or the next business day if the scheduled date falls on a weekend or public holiday):

7.3 All draws will take place at the Promoter’s office at 7/418a Elizabeth Street, Surry Hills NSW 2010 at 12:00 pm AEST on each draw date (or as soon as reasonably practicable thereafter).

7.4 Each draw will be conducted by electronic random number generator or manual barrel draw, ensuring each valid entry has an equal chance of being selected.

7.5 The Promoter may appoint an independent scrutineer to oversee any draw at its discretion.

 

8. Prizes

8.1 There are six (6) prizes in total. Each prize consists of:

One (1) Sony PlayStation 5 console (disc or digital edition, at the Promoter’s discretion), valued at approximately AUD $799 (inclusive of GST) at the date of these Terms and Conditions.

8.2 Total prize pool value: AUD $4,794 (inclusive of GST).

8.3 Prize values are correct at the time of printing and the Promoter accepts no responsibility for any variation in prize values.

8.4 An entrant may only win one (1) prize during the Promotional Period. If an entrant is drawn in a subsequent draw after already winning, a redraw will be conducted.

8.5 Prizes are not transferable, exchangeable, or redeemable for cash. The Promoter accepts no responsibility for any variation in prize value.

8.6 If a prize (or any element of a prize) becomes unavailable for any reason beyond the Promoter’s reasonable control, the Promoter reserves the right to substitute a prize of equal or greater value, subject to any applicable legislation.

 

9. Winner Notification and Prize Claim

9.1 Each winner will be notified by email and/or telephone within five (5) business days of the relevant draw.

9.2 The Promoter will make reasonable efforts to contact each winner using the contact details associated with their FoodByUs account. It is the entrant’s responsibility to ensure their contact details are current and correct.

9.3 If a winner cannot be contacted, or does not respond to claim their prize, within fourteen (14) days of the initial notification attempt, the Promoter reserves the right to conduct a redraw for that prize.

9.4 Unclaimed prize redraws will take place at the Promoter’s office at 7/418a Elizabeth Street, Surry Hills NSW 2010 at 12:00 pm AEST on a date no later than three (3) months after the original draw date for that prize.

9.5 The winner of any unclaimed prize redraw will be notified in the same manner as set out in clauses 9.1–9.3 above.

9.6 If, after the unclaimed prize redraw, the prize remains unclaimed for a further fourteen (14) days, the Promoter will deal with the unclaimed prize in accordance with applicable state and territory legislation.

 

10. Publication of Winners

10.1 The business name of each winner may be published on the FoodByUs website (https://www.foodbyus.com.au) and the Promoter’s social media channels within 28 days of each draw.

10.2 In accordance with applicable state and territory legislation, the names of winners of prizes valued at $1,000 or more will be published on the Promoter’s website at https://www.foodbyus.com.au/unilever-promo/ for a minimum period of 28 days.

10.3 By entering the Promotion, each entrant consents to the publication of their business name and state/territory of residence in connection with the Promotion.

 

11. Privacy

11.1 The Promoter collects personal information from entrants for the purpose of conducting and administering the Promotion, including determining eligibility, notifying winners, and publishing winner details as described in clause 10.

11.2 The Promoter may share entrants’ personal information with:

(a) Unilever Australia Limited, for the purpose of fulfilling and administering the Promotion;

(b) the Promoter’s related bodies corporate and service providers, to the extent necessary to conduct and administer the Promotion; and

(c) relevant state and territory gaming authorities, as required by law.

11.3 If an entrant does not provide the personal information requested, the Promoter may not be able to enter the person into the Promotion or award them a prize.

11.4 The Promoter will handle all personal information in accordance with its Privacy Policy, available at https://www.foodbyus.com.au/privacy-policy/.

11.5 Entrants may access, update, or correct their personal information by contacting the Promoter at support@foodbyus.com.

11.6 The collection, use, and disclosure of personal information provided in connection with this Promotion is governed by the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

 

12. Limitation of Liability

12.1 To the fullest extent permitted by law, the Promoter (including its officers, employees, agents, and contractors) and Unilever Australia Limited exclude all liability for any loss, damage, injury, cost, or expense (including without limitation any indirect, consequential, or special loss or damage, or loss of profit, revenue, data, or goodwill) suffered or incurred by any entrant or winner in connection with the Promotion, including:

(a) any technical, hardware, software, server, website, or other failures or damage of any kind that may limit or prevent an entrant’s ability to participate in the Promotion;

(b) any theft, unauthorised access, or third-party interference;

(c) any entry or prize claim that is late, lost, altered, damaged, or misdirected;

(d) any variation in prize value;

(e) any tax liability incurred by a winner; and

(f) the use or enjoyment of a prize, or any accident or injury arising from or connected with the use of a prize.

12.2 Nothing in these Terms and Conditions is intended to limit or exclude any consumer guarantee, right, or remedy under the Competition and Consumer Act 2010 (Cth) (including the Australian Consumer Law) or any other applicable law that cannot be excluded by agreement.

12.3 To the extent that the Promoter’s liability cannot be excluded, it is limited to the maximum extent permitted by law.

 

13. General Conditions

13.1 The Promoter reserves the right to request verification of age, identity, and eligibility conditions from any entrant, and to disqualify any entrant who fails to provide such verification to the Promoter’s satisfaction.

13.2 The Promoter reserves the right, at its sole discretion, to disqualify any individual who:

(a) tampers with, or attempts to tamper with, the entry process or the operation of the Promotion;

(b) acts in a manner that is contrary to these Terms and Conditions;

(c) engages in any conduct that is fraudulent, misleading, deceptive, or generally damaging to the goodwill or reputation of the Promoter or Unilever; or

(d) does not comply with these Terms and Conditions.

13.3 Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

13.4 If for any reason the Promotion is not capable of running as planned (including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures, or any other cause beyond the Promoter’s reasonable control that corrupts or affects the administration, security, fairness, integrity, or proper conduct of this Promotion), the Promoter reserves the right, in its sole discretion, to:

(a) cancel, terminate, modify, or suspend the Promotion; or

(b) invalidate any affected entries,

subject to any applicable legislation.

13.5 These Terms and Conditions are governed by the laws of New South Wales, Australia, and the parties submit to the non-exclusive jurisdiction of the courts of New South Wales.

13.6 If any provision of these Terms and Conditions is found to be invalid or unenforceable, that provision will be severed to the extent of the invalidity or unenforceability, and the remaining provisions will continue in full force and effect.

13.7 These Terms and Conditions constitute the entire agreement between the Promoter and each entrant in relation to the Promotion.
